It’s all about the Judge, says Attorney Don Loose. Kari Lake and Mark Finchem both lost their cases that challenged the results of the 2022 election. Mr. Finchem’s judge found his case to be groundless and sanctioned Mr. Finchem and his attorney to pay his opposing party’s (Adrian Fontes’) attorney fees. Ms. Lake, on the other hand, was not ordered to pay attorney’s fees because her judge determined that, even though she lost, she had substantial justification to bring the suit. The two lawsuits were very similar, but the outcome depends on each judge’s discretion.

The Arizona Court of Appeals overturned a lower court ruling which will broaden the impact of the law legalizing recreational marijuana. The law says that if an individual has two and a half ounces or less, it is legal in most cases. This means that potentially hundreds of thousands of people with prior marijuana convictions may petition to have their records expunged.

Attorney General, Kris Mayes, has filed a suit against manufacturers of “forever chemicals”, or PFAS, which have caused widespread contamination of the state’s groundwater. The lawsuit is now one of the hundreds of such cases throughout the country. This case would make the chemical manufacturers, including 3M, DuPont and others, liable to Arizona for the cost of remediation – a multi-million dollar claim.
